2010

ILF is pleased to announce the completion of legal due diligence for Agroliga Group of Agricultural Companies in connection with the group’s anticipated private placement offering on NewConnect platform of the Warsaw Stock Exchange (WSE). Being the first Ukrainian company to declare the decision to enter the WSE alternative financing and trading platform, Agroliga Group resolved to conduct a comprehensive and objective due diligence procedure to provide detailed and transparent information on enterprises’ activity.

ILF lawyers assessed the agreements and obligations of the group, examined the companies’ involvement in litigation processes, conformed the permission documents for business activities, and their compliance with national and European legislation.

The project was led by ILF senior partner Olena Kibenko. Legal due diligence resulted in a detailed report comprehended by ILF team, which is to be submitted in the overall package of documents provided by Agroliga Group of Companies for private placement offering on NewConnect alternative platform.

ILF has successfully completed a project on development of a legal mechanism enabling orphan centers to set up rehabilitation groups for handicapped children who live in families, as well as mother and baby groups.

The project has been implemented in cooperation with the specialized orphan center ¹ 1 in Kharkiv. According to the effective legislation, such institutions provide rehabilitation to orphan children, and are prohibited to work with handicapped children living in families. At the same time, specialized orphan centers often don’t use their capacity to the full, which can allow of providing medical assistance to not only orphans but also others in need.

Within the project, ILF partner Sergiy Silchenko worked out the Provision on medical and social rehabilitation groups of an orphan center. The team of ILF lawyers under the supervision of Mr. Silchenko has drafted amendments to the foundation documents and other documentation of the institution which will enable its conducting rehabilitation to an expanded number of patients.

The project was supported by the Kharkiv Regional State Administration and Kharkiv Regional Council. This successful experience is also possible to be implemented in other regions of Ukraine.


ILF partner Sergiy Silchenko and senior attorney Olena Petrova have successfully defended the big national producer of power-plant equipment SE plant “Electrotyazhmash” in the Higher Administrative Court of Ukraine in a case involving the plant’s suit against the Specialized State Tax Inspection for Work with Big Taxpayers related to made amendments to the taxpayer’s record card which amounted to about UAH 2 mln.


The proceedings in the case resulted into partial satisfaction of the appeal, reversal of a prior decision of the Kharkiv Administrative Court of Appeal made in favor of the tax body, as well as referral of the case for a new consideration to a court of the first instance.

ILF is defending interests of a Ukrainian telcommunication company Velton.Telecom in a debt collection lawsuit filed against it by another Ukrainian mobile operator Kyivstar GSM.

A decision made by the Economic Court of Kharkiv Region in this case was earlier recalled by the Supreme Economic Court of Ukraine and referred for further consideration.

ILF junior attorney Dmytro Lazebny under the supervision of senior attroney Olena Khytrova will  represent the client’s interests in the Economic Court of Kharkiv Region.

ILF acts as legal advisor to the establishment of a private clinic in Kharkiv. The clinic plans to apply innovative technologies never used in the Ukrainian medical practice before, as well as to set up a branch of a specialized higher educational establishment’s department.

ILF attorneys will provide legal support to all stages of the project implementation, including consulting on corporate and intellectual property law issues. The experts will also provide coordination of the clinic’s collaboration with national and foreign medical universities.

ILF attorneys Olena Kolesnichenko and Anton Zinchuk are engaged in the project led by the firm’s partners Olena Kibenko and Sergiy Silchenko.

ILF attorneys have secured a court victory for a big bank which will receive UAH 29 mln as a debt recovery. The litigation turned out to be long-running and complicated since the debtor tried to annul the loan agreements and agency contracts, disputing and delaying proceedings in the case. Consequently, besides the main case, the firm’s advisors handled three more cases on invalidation and termination of the agreements.

ILF team representing the bank’s interests in the court was led by partner Oleksiy Kharytonov and included attorneys Olena Khytrova, Anna Gebeleva, and Dmytro Lazebny.

ILF has been appointed a legal advisor to Agroliga Group of Agricultural Companies in connection with the group’s anticipated private placement offering on NewConnect, an alternative financing and trading platform of the Warsaw Stock Exchange (WSE).

Agroliga Group is the first medium-sized Ukrainian company which declared the decision to debut on NewConnect platform through sale of non-control equity interest and stepped into the pre-offering stage. The listing is scheduled for the third quarter of 2010. The proceeds of the offering will be invested into development and launch of the second phase of the company’s sunflower seed processing plant. The group’s roadshow is scheduled to take place in May-June 2010 in Poland.
ILF will perform a full-blown due diligence of Agroliga Group, advise on structuring of the holding company, as well as will provide legal support while the group's listing on the NewConnect platform. The due diligence report will be finalized by April 2010.

ILF won advisory role to the Institute for Single Crystals State Scientific Institution of the National Academy of Sciences in Ukraine, the country’s powerful scientific center of functional materials development, in its new project on government purchases. In particular, the firm’s lawyers provide legal support in planning and implementing efficient purchase schemes. The work on the project is led by ILF partner Sergiy Silchenko.

ILF advises large retailing Ukrainian company with foreign investment on the acquisition warehouses with total area of 11 thousand square meters in Donetsk.

ILF conducted due diligence and supported the contract of sale of a Ukrainian travel agency. The firm represented the buyer’s interests. At the present time, the system of the company management is being structured.
The contract was supported by the ILF lawyer Elena Kolesnichenko and under the guidance of the ILF senior partner Olena Kibenko.

ILF has successfully defended the interests of the big Ukrainian gas producing company in the dispute with the regulatory authorities concerning legality of issuing the license for development the gas field in Luhansk region. The interests of the company in court were represented by the senior ILF lawyer Elena Petrova.
ILF conducted the due diligence of a plot in Boryspil district of Kyiv region by the order of a big Polish investor. The purchasing of the plot is for agricultural business.
The lawyers of ILF Anna Zhebeleva and Elena Khitrova consult American company in the dispute that appeared with the Kharkiv Customs of the State Customs Service of Ukraine while importation of medicines in the country.
Law firm ILF began advising a major foreign investor for the construction of grain elevators in Ukraine.
2009

The project is implemented jointly with a specialized children’s home number 1. According to the information of Roman Marabyan - the head doctor of the establishment, according to Ukrainian law such institutions doesn’t imply the possibility of working with handicapped children, who are in families. At the same time, specialized children's homes are not always packed, even on two-thirds. Specialized children's homes are under the command of the Ministry of Health. At this moment there is a letter from the office, which is about the principle consent to create groups of rehabilitation for children in families with health problems on the basis of children's homes. The creation of rehabilitation groups should be placed for consideration at the December session of the Kharkiv Regional Council. 


The resolution of the dispute in favour of a bank under the claim about debt recovery under the credit at the rate about 8 000 000 UAH is finished at Commercial court of Kharkiv region. The Decision about the recovery is valid.
Bank’s interests in the litigation were represented by the attorney of the firm Zhebeleva Anna.
Haritonov Alexey supervised this project.

 The attorneys of Litigation practice in the name of LLC “Volvo-Ukraine” perform the row of measures throughout Ukraine, directed on recovery and return of an amount of debts for rendered services and executed works in repair of trucks of VOLVO from more than 35 debtors. On the majority of such cases Commercial Courts’ Decisions on recovery of an amount of debt, penalty fees and inflationary fees were already taken.


Row of measures directed on organization and conducting by Government Executive Office of a public bidding on sale of the real estate on account of credit debt repayment were held by the attorneys of Litigation practice ILF under the direction of Oleksiy Kharitonov.

Senior attorney of Litigation practice ILF Olena Khytrova represented interests of Deputy Governor of Kharkiv region Storogenko S.M. in a case on protection of honour, dignity and business reputation. Under the Decision of Kyiv district Court of the city of Kharkiv from October 13, 2009 the claim was rejected.



ILF attorneys represented interests of Sevastopol municipal State Administration in a case on lawsuit of a private person on adjudgment of illegal inactivity on the non consideration of his application about transfering into the ownership of 4,8 hectare land area, located in Sevastopol, and also about the obligation of Sevastopol municipal state Administration to adopt the application of the grant into ownership of land area , to form the package of documents, to prepare the conclusion and to present it to Sevastopol City Council.
Senior attorney Olena Khytrova, the attorney Anna Gebeleva developed a legal strategy for this case. 
Kharkiv county administrative Court has rejected the claim, by its Regulation from November 11, 2007, and the claim was kept without changes under the Decision of Kharkiv Administrative Court of Appeal from July 31, 2009 and the Regulation of Supreme Administrative Court from October 28, 2009.



ILF attorneys represented Institute’s interests in a Case on lawsuit of Pharmaceutical Company Open Joint Stock Company «Farmak»   on disclaimer of inadequate information about drug of generic origin  “Epovitan” and about the recovery of 6,5 thousand $ of moral damages.
The firm’s partner Oleksiy Kharytonov, senior attorney Olena Khytrova developed a legal strategy and represented clients’ interests in a court. Under Commercial Court’ decision the claim was rejected and kept without changes under the Decision of Kyiv Commercial Court of Appeal, 15 April, 2009, under the Decision of  Supreme Commercial Court, 14 July, 2009.



ILF represented interests of a Large Ukrainian bank  in several lawsuits on debt recovery filed against the Co Ltd “M”. General indebtedness was 16.5 million USD.
The firm attorneys Olena Khytrova, Anna Gebeleva and Dmitriy Lazebny represented bank’s interests in the courts of different instances and held executive actions on this matter. This project was held under supervision of Oleksiy Kharytonov who is a partner with the firm's litigation practice.
ILF attorneys have developed a complex strategy on settlement of such disputes that helped them to attain full repayment of the indebtedness.  


ILF partner Sergiy Silchenko represented the National University of Pharmacy in the court of first instance.  The points of this case were reinstatement in work of a person, dismissed from the position of dean due to the fact of University reorganization, and payment of the forced truancy compensation. The lawsuit had been lasting for the year and a half. The court accepted the defendant’s arguments and adjudged legal and objective decision. According to the court decision the plaintiff’s claims was dismissed.   

INYURPOLIS attorney Anton Zinchuk advised Municipal Company "Kharkiv Regional Philharmonic" during the conclusion of the Agreement on Services with the Acoustic Design Ahnert Firm (Federative Republic of Germany). Among other services the scope of the agreement included the services on development of recommendations to ensure the best possible acoustic characteristics for the Philharmonic's new organ hall. Acoustic Design Ahnert Firm was represented by a world renown expert Dr. Wolfgand Ahnert.
On February 16, 2009 INYURPOLIS partner Sergiy Silchenko and INYURPOLIS senior attorney Evgen Grekov won a lawsuit in the Kharkiv Commercial Court of Appeals where they represented the National Pharmaceutical University. The Kharkiv Commercial Court of Appeals let stand the decision rendered by the Commercial Court of the Kharkiv Region on December 16, 2008 that dismissed a claim of INTERNAUKA Association of Educational Institutions on the recovery of fees for the services on attraction of foreign citizens to attend the University. Hereby, an important precedent was formed for the cases associated with recovery of fees by agent-companies inviting foreign students to attend Ukrainian universities.
2008
INYURPOLIS experts Olena Kibenko (Corporate and M&A), Irina Selivanova (Public Property), and Olena Pelypenko (Corporate and M&A) provided consultations and legal support in privatization of a going concern of Kherson Glasswork. Previously, the Glasswork was leased out to Closed Joint-Stock Company "UKRSKLOPROM". The project was a unique experience for INYURPOLIS attorneys because it was the first privatization of a publicly owned going concern in Ukraine.
Group of INYURPOLIS attorneys under the supervision of Yaroslava Onika, who is the partner with the firm's real estate practice, provided legal advise to a major Ukrainian bank on how to exclude a facility owned by a bank from the List of Architectural Monuments and Facilities Prohibited from Privatization.
Olena Kibenko, INYURPOLIS senior partner, advised a group of Danish investors on optimal investment into construction of  residential facilities in Ukraine. 
Olena Kibenko, INYURPOLIS senior partner, and a group of INYURPOLIS attorneys provided legal support in privatization of Hotel Kyivskyi going concern located in the historical centre of Kharkiv. During the privatization process INYURPOLIS attorneys had to resolve a number of issues associated with the transfer of a business to a new owner (obtaining appropriate licenses and approvals, staff transfer, negotiations with creditors, etc.).
In December of 2008 Oleksiy Kharytonov, partner with INYURPOLIS litigation practice, and INYURPOLIS senior attorney, Olena Khytrova, represented a major Ukrainian bank before the Supreme Court of Ukraine in a case on nullity of a notary's record on a mortgage agreement.
INYURPOLIS attorneys provided legal advise on and support in issuance of purpose bonds by Corporation "VELTON". The bonds were issued to finance construction of a premium-class residential complex in the centre of Kharkiv. The amount of funds attracted by the issuance of bonds exceeded UAH 30 million.

Partner with INYURPOLIS real estate practice, Yaroslava Onika, and other attorneys of the firm finalized the documents that confirmed the right of MTS to use land plots in the Kharkiv Region for installation of mobile communication base stations.
Partner with INYURPOLIS litigation practice, Oleksiy Kharytonov, represented a Kharkiv based development company before a district administrative court in a case initiated by a state tax agency to repeal the agreement on marketing services and to recover damages caused to the state.
Group of INYURPOLIS attorneys under the supervision of Olena Kibenko performed due diligence of MEGABANK. One of the requirements from the European Bank for Reconstruction and Development to open a line of credit for MEGABANK was that the due diligence had to be conducted by a competent law firm.
INYURPOLIS attorneys performed due diligence of a Kharkiv based development company and of the land plot owned by the company for construction purposes. The due diligence was conducted at the initial stage of the investment project on construction of a premium-class residential complex with parking.
INYURPOLIS attorneys performed due diligence of a major medical diagnostics centre "Alpha Medical" (Alpha Medical Ukraine LLC) the facilities of which are located in Dnipropetrovs'k and Kharkiv. The due diligence was ordered by a foreign shareholder of the LLC. Olena Kibenko, senior partner with INYURPOLIS, lead the group of the following attorneys on this project: Olena Pelypenko (Corporate Law), Anton Zinchuk (IP and Contracts), Andriy Leskovs'kyi (Corporate Law), Yaroslava Onika (Real Estate) and Sergiy Silchenko (Labor and Employment). Presently, the firm's attorneys provide the LLC with comprehensive legal support in its day-to-day business activity.
Yaroslava Onika, partner with INYURPOLIS real estate practice, acted as a legal advisor to Construction Corporation "AVANTAZH" in matters of the procedure of commissioning facilities pursuant to the new rules of the Procedure for Commissioning of Ready-Built Facilities that came into force in 2009.
Olena Khytrova, senior attorney with INYURPOLIS litigation practice, succeeded in a lawsuit on protection of intellectual property rights to the trade mark "MASTER+" of the TORGSERVIS LLC. The Kharkiv Regional Commercial Court satisfied the claims and ruled on destruction of the infringing merchandise.


Managing partner with INYURPOLIS, Tetyana Gavrysh, was appointed as a member of the committee established to work on the program for reconstruction of the cultural heritage monuments in the Kharkiv Region. Among others, the following famous monuments were covered by the program: Castle "Sharivka", Castle "Staromerchenskyi", landscape monument "Nataliivsyi". INYURPOLIS attorneys under the supervision of Mrs. Gavrysh developed possible schemes for attracting private investments into the reconstruction of the monuments and development of the adjacent territories (creation of infrastructure for international tourism).

Oleksiy Kharytonov provided legal consultations to the pharmaceutical division of "Johnson & Johnson" on matters of legal strategy in a lawsuit on protection of IP rights to a drug that treats ontological diseases. The claims also covered registration termination of a rival generic drug.
A group of INYURPOLIS attorneys under the supervision of Yaroslava Onika legally supported the turnkey construction project of the "MAMIN DOM" baby goods store chain with subsequent perfection (registration) of ownership rights to the real estate facilities.
INYURPOLIS attorneys (Yaroslava Onika, Mykola Kutsekon) are preparing a legal scheme on acquisition of the "ZANKI" Recreation Center from the State Company "MALYSHEVA Plant".   
Sergiy Silchenko, the firm's partner, won the appeal in the Kharkiv Region Court of Appeals where he represented the Head of the Kharkiv Region State Administration, Arsen Avakov. The Court dismissed the lawsuit on protection of honor, business reputation, and moral damages recovery filed by the Kharkiv Region Council deputies Volodymyr Proskurin and Valeriy Tsurtko. The Court's decision confirmed the fact that the mentioned deputies' hunger strike in the office of the Kharkiv Region State Administration in October of 2006 had the nature of an opinion and not a solid fact that can be refuted.            

INYURPOLIS attorneys prepared the legal schemes for perfection (registration) of a title to use subsoil for mining operations by quarrying on the territory of Barvinkivskyi District in the Kharkiv Region (total area of the plot is 15 hectares). The project is supervised by INYURPOLIS partner Yaroslava Onika.

INYURPOLIS attorneys (Olena Kibenko, Yaroslava Onika) participated in preparation of the Temporary Regulations by the Kharkiv Regional Council "On Organization of Tenders for Investment into Social and Cultural Real Estate Development Projects in the Kharkiv Region and on Acquisition of Ownership Rights by Investors to Existing Real Estate Municipal Facilities". The Regulations govern the procedures of organization of tenders for investment into development of social and cultural real estate projects in the Kharkiv Region funded with non-budget moneys obtained from private investors.
INYURPOLIS attorneys Yaroslava Onika, Iryna Selivanova, and Olena Parkhomenko provided legal support in leasing of the going concern of the Municipal Trading and Public Catering Company "YUNOST -92" to a staff-managed company. A procedure of this nature was executed in Kharkov for the first time.  
INYURPOLIS attorneys Olena Kibenko, Iryna Selivanova, and Yaroslava Onika provided legal support in conclusion of the Agreement on Lease of the International Kharkiv Airport. The firm represented the Lessee of the facility. Presently, INYURPOLIS attorneys render comprehensive assistance with reconstruction and restructuring of the Airport due to its transfer into lease.
Yaroslava Onika provided consultations to Construction Company "VELTON" on the procedure for entering into land lease agreements in 2009. The changes to the procedure of land lease were entailed by the amendments to the Land Code of Ukraine.

INYURPOLIS real estate partner Yaroslava Onika and the firm's attorney Mykola Kutsekon designed a scheme to change the purpose designation (zoning) of a forest land plot on which a sport camp is located. The total area of the plot is 5 hectares.
INYURPOLIS litigators supervised by Oleksiy Kharytonov who is a partner with firm's litigation practice, represented Closed Joint-Stock Company "ÒEC-3" in commercial courts of all the instances in a lawsuit filed against the Kharkiv City Council to recover the debt in the amount of USD 2,887,712.
INYURPOLIS of counsel Iryna Selivanova and partner Sergiy Silchenko who is in charge of the firm's labor & employment practice were appointed to the workgroup of scholars of the Yaroslav Mudryi National Law Academy to participate in drafting of the new version of the Act of Ukraine "On Higher Education". The new Act is being developed by the Ministry of Education and Science of Ukraine due to Ukraine's joining the Bolognese Charter.
INYURPOLIS litigators supervised by Oleksiy Kharytonov, partner with the firm's litigation practice, represented Closed Joint-Stock Company "ÒEC-3" in the Commercial Court of the Kharkiv Region in a debt recovery case suit (debt amount - USD 7,166,606).

In June of 2008 a group of INYURPOLIS attorneys under the supervision of Yaroslava Onika, who is a partner with INYURPOLIS real estate practice, provided legal support with perfection (registration) of a title to a non-residential facility the total area of which is 15,000 square meters The total cost of the facility is approximately USD 6 million.

INYURPOLIS attorneys Olena Kibenko, Iryna Selivanova, Yaroslava Onika, Mykola Kutsekon, and Akop Vardanyan were appointed to a workgroup to finalize the new version of the Air Code of Ukraine. The presented draft contains provisions that introduce fundamentally new approaches to the regulation of air transportation.

Yaroslava Onika and a group of INYURPOLIS attorneys provided legal support to the Medical Centre "RADUGA" in obtaining of the required construction permits and licenses, and perfection (registration) of ownership rights to the facilities of the Medical Centre.  
INYURPOLIS attorneys finalized due diligence of YURINCOM INTER - one of the largest publishers of legal literature in Ukraine. The due diligence was ordered by foreign shareholders (Poland, Switzerland). Olena Kibenko, senior partner with INYURPOLIS, supervised the group of attorneys involved in the project (Sergiy Silchenko, Yaroslava Onika, Olena Khytrova, Anton Zinchuk, Olena Pelypenko, Olena Parkhomenko and Iryna Selivanova).
Yaroslava Onika, partner with INYURPOLIS real estate practice, and a group of INYURPOLIS attorneys provided consultations and legal support in perfection (registration) of a title to a land plot designated for construction purposes, obtaining the permits and licenses required for construction, and in commissioning of the residential complex "Usad'ba Chernyshova" (Kharkiv). The total area of the complex is 7,500 square meters (project budget - UAH 7 million).
Oleksiy Kharytonov, partner with INYURPOLIS litigation practice, and INYURPOLIS senior attorney, Olena Khytrova, represented the local self-governance authority of the Autonomous Republic of Crimea in a local administrative court and in an appellate administrative court in the case on nullity of the decision by that authority on allocation of the land plot of total area 4.8 hectares located in a costal zone.
INYURPOLIS attorney Mykola Kutsekon provided legal support in conclusion of an agreement between state authorities and land plots owners on transfer of the land plots to the reserved lands fund. The total area of the transferred land plots constituted more than 100 hectares.
INYURPOLIS senior attorney, Olena Khytrova, represented a major insurance company before a Kharkiv local court in a lawsuit filed by an individual to recover insurance compensation in the amount of USD 183,334.
2007
INYURPOLIS attorneys represented a state military company in a lawsuit on protection of IP rights to the patented technical solutions against their unauthorized usage in a drill mechanism that caused damages in the amount of UAH 1.3 million. The firm's attorneys in close cooperation with a patent attorney performed extensive research of the matter, including the claim, to ensure the positive outcome of the case for our client.
INYURPOLIS partner Oleksiy Kharytonov represented shareholders of a major Ukrainian development company in a number of lawsuits about the disputes between the shareholders and between the shareholders and the state registrar of securities. Litigation strategy implemented by the firm's litigators allowed to prevent a hostile takeover of our clients' company.
INYURPOLIS attorneys participated in the due diligence of the Ukrainian National Lottery  - the second largest state lottery in Ukraine. The due diligence was conducted in cooperation with the Czech law firm Rowan Legal. The following INYURPOLIS attorneys were involved in the project: Olena Kibenko, Olga Sin, Olena Pelypenko, Olena Chabanovska, Iryna Danylenko, Sergiy Turchyn, Sergiy Andriyenko.
INYURPOLIS attorneys represented the Head of the Kharkiv Region State Administration (Governor) in the lawsuit versus the Kharkiv Regional Council on recognition of the decision by the Council to impeach the Governor as null and void. The Supreme Court of Ukraine issued an unprecedented decision in which it supported our attorneys' position on the illegality of the decisions by the self-government authorities that were made with violations of the set procedure. 
INYURPOLIS attorneys legally assisted Vadim Mulerman with the foundation of the Musical Theater in which young talented artists of the Kharkiv Region will study singing, choreography, and acting. Vadim Mulerman was born in Kharkiv. He is an Honored Artist of the Russian Federation and Ukraine. Starting from 1989 Vadim Mulerman lived and worked in the United States where he created a musical theater for children in Florida. In 2003 he returned to Kharkiv.
Olena Kibenko provided legal support to the State Enterprise plant "Electrotyazhmash" in conclusion of agreements on export of turbo generators to India and Kazakhstan.

INYURPOLIS attorneys represented a Ukrainian debtor during the preparation of a loan agreement with a Czech bank for the loan amount of 15 million Euros.

2006
INYURPOLIS attorneys represented a central executive authority in the Kharkiv Region in a lawsuit on reinstatement of employment of its former senior official. To represent the Client in this case the firm's attorneys had to expensively research numerous legal issues on the application of contradictory internal rules. The decision in this lawsuit was made in favor of our Client and subsequently confirmed by the Appellate Court and the High Administrative Court of Ukraine.
INYURPOLIS attorneys consulted the Russian Airline "SIBIR" on the strategy in a lawsuit  against the Defense Ministry of Ukraine to recover damages in the amount of USD 16 million caused by the crash of TU-134 airbus owned by the Client.
The firm's attorneys represented the Kharkiv City Council in a lawsuit on nullity of a decision by the Executive Committee of the Kharkiv City Council. That decision approved the new tariffs for housing services. The case was complicated because an extensive research had to be performed to check if the client complied with the procedure on monitoring a regulatory influence of the passed decision upon public relations. A first instance court completely rejected the suit. 
INYURPOLIS attorneys represented a national gas-transport company in a bankruptcy of one of the major companies in the field. Based on the strategy designed by the firm's attorneys, an amicable agreement was entered into by the parties. Pursuant to that agreement the debtor assumed obligations to repay the debt by monthly installments. The amount of the debt constituted UAH 10 million.

2005
INYURPOLIS attorneys represented a major state military company during the enforcement of the judgment on reimbursement of UAH 800 thousand. Due to the strategy chosen by the firm's attorneys and a number of successful negotiations with the debtor, the amount of the debt was refunded in full. 
INYURPOLIS attorneys represented a state military company  in a lawsuit to recover from that company damages caused by improper execution of obligations pursuant to the additional agreement to the main agreement. The case was complicated by the necessity to carry out a number of forensic examinations and to research numerous legal contradictions on the qualification of the additional agreement as a novation. Precedent court decisions were subsequently approved by the Supreme Court of Ukraine. 
INYURPOLIS attorneys Olena Kibenko and Denys Bugay legally supported the change of name and registered office of an insurance company after 50% of its shares were acquired by the Mariupol Metallurgical Plant named after Il'ich. The new name of the insurance company is "Il'ichyovskaya" and the new registered office is located in Kyiv.
INYURPOLIS partners Tetayana Gavrysh and Olena Kibenko consulted the Head of the Kharkiv Region State Administration, Arsen Avakov, in matters related to the transfer of his business under the management of a foreign trust company.

To implement the project the firm's attorneys drafted a number of agreements and local acts necessary for the Center to operate and are continuing to ensure its day-to-day business activity.
The Firm's attorneys represented the Kharkiv City Council in a lawsuit on nullity of a decision by the Executive Committee of the Kharkiv City Council. By that decision the Executive Committee approved the new tariffs for housing services. The case was complicated because of an extensive research had to be performed  to check if the client complied with the procedure for monitoring a regulatory influence of the passed decision upon public relations. A court of the first instance completely rejected the suit.
2004
INYURPOLIS attorneys represented a national state military defense company in a court dispute with the State Company "Ukrspetsexport" to recover damages in the amount of UAH 11 million caused by the failure to comply with the terms and conditions of the Foreign Economic Contract on Defense Sale. This case was complicated by the work with confidential information that made it necessary to conduct special procedural actions to collect evidence. In addition, the firm's attorneys acted as arbiters on behalf of the Client before the arbiters that represented the State Company "Ukrspetsexport" during the pre-trial negotiations.  
Starting from 1999 until 2004 INYURPOLIS Law Firm represented a national gas-transport company and its branches in numerous sophisticated debt recovery cases to collect debts for gas transportation services. Such cases were complicated by circumstances because of which the firm's attorneys had to substantiate to the courts the amounts of the debts the term of which had expired. Overall, we represented this Client in more than 400 cases and succeeded in collection of about UAH 162 million.
A group of attorneys under the supervision of the firm's partner Yaroslava Onika legally supported the execution of licensing documentation, perfection (registration) of the title to use the land plot for construction, and the commissioning of the Resedential Complex "Sadovaya Gorka", the total area of which is 30,000 sq. meters. The price of the project constituted USD 30 million.
